1. Introduction

1.1 These Terms and Conditions ("Terms") govern your use of our services provided by Talent Torch Recruitment Ltd ("we", "us", or "our"), accessible through our website, www.thetalenttorch.com ("our website").

1.2 By using our services, you agree to these Terms, which form a binding legal agreement between you and Talent Torch Recruitment Ltd.

2. About Talent Torch Recruitment Ltd

2.1 Talent Torch Recruitment Ltd is a UK-based headhunting firm specialising in sourcing outstanding employees from the Philippines at a fraction of UK cost. We connect remote contractors from the Philippines with various companies, managing the recruitment process to ensure quality placements.

2.2 Our registered office is in the UK, and we operate primarily through our website and other digital platforms.

3. Our Services

3.1 We offer recruitment services, including headhunting, vetting, testing, interviewing, and referencing candidates. Our services are designed to provide our clients with three candidates for interview and selection.

3.2 Clients are required to pay an upfront fee of £300 (inc.VAT) to initiate the search process. Upon successful placement, a monthly fee, of $2000, $2500 or $3000 based on the level of experience of the candidate is charged. If the client opts for the headhunting service only the fee is calculated as 35% of the candidate's assumed first year's salary.

3.3 In the event a candidate does not fulfil their role within 90 days, we offer a complimentary re-run of the search process at no additional cost. For our managed service we will re-run the search and replace the candidate.

3.4 We’re happy to refund your £300 upfront fee if you don’t hire a candidate through us, but to keep things fair for both sides, here’s how it works: The £300 upfront fee is refundable only if the client has interviewed at least three (3) candidates provided by Talent Torch and submitted written feedback within 14 days of the interviews, detailing why each candidate was not suitable for the role.

3.5 Refund requests must be submitted in writing within 14 days of the final candidate presentation. If no request is made within this period, the £300 upfront fee becomes non-refundable.

3.6 If the client fails to respond to Talent Torch’s communications, including emails, phone calls, or other agreed-upon methods, for a period of 14 consecutive days, the £300 upfront fee shall become non-refundable. Talent Torch will make reasonable efforts to contact the client during this period.

3.7 Talent Torch commits to providing up to two (2) replacement candidates at no additional charge within a 6-month period from the start of the original candidate’s engagement, should the original candidate cease to fulfill the role for any reason. If additional replacements beyond this limit are required within the same 6-month period, Talent Torch reserves the right to charge an additional fee for each subsequent replacement.

3.8 The client agrees not to hire, engage, or contract, directly or indirectly, any candidate introduced by Talent Torch for a period of 12 months following the termination or conclusion of the engagement with Talent Torch. Should the client violate this clause by hiring or engaging the candidate outside of this agreement, the client shall be liable to pay Talent Torch a penalty equivalent to 35% of the candidate’s assumed first year’s salary as liquidated damages. The assumed first year’s salary will be based on the monthly fee charged to the client multiplied by 12.

4. Candidates

4.1 The placed candidate is entitled to the amount of annual leave and sick leave as specified in their contract. Any leave taken by the candidate beyond these entitlements will be considered unpaid leave. For each day of unpaid leave, the monthly fee will be reduced by a pro-rated amount, calculated by dividing the monthly fee by the number of days in that month. The candidate or client must notify us in writing of any unpaid leave to ensure accurate billing adjustments. In the event of a permanent leave of absence or an extended absence exceeding 30 consecutive days, we reserve the right to pause billing or arrange for a replacement to fulfil the role.

4.2 The candidate’s pay, and consequently the monthly fees charged to the client, will be reviewed annually and may be adjusted in line with the UK Consumer Price Index (CPI) rate, typically ranging from 2–3% per year, to ensure fairness to the contractor. Talent Torch will contact the client annually to discuss whether they are happy with this change, If the client is not satisfied with the proposed pay adjustment, they may cancel the agreement by providing 30 days’ written notice. During this period, Talent Torch will assist in finding a suitable replacement if requested. We will also contact the client to enquire as to whether they would like to grant the candidate a pay rise or bonus.

5. Use of Our Services

5.1 Candidates applying for roles must submit their application through our career page, Facebook page, or job boards. Applications must include an accurate email address, CV, LinkedIn URL, and first and last names.

5.2 Clients must pay the refundable upfront fee to commence the search process. This payment is facilitated through Stripe.

5.3 The client agrees not to hire, directly or indirectly, any candidate introduced by Talent Torch for a period of 12 months following the introduction, unless the hiring process is completed through Talent Torch. If the client hires such a candidate outside this agreement, the client shall pay Talent Torch the full placement fee, and the upfront fee will remain non-refundable.

5. Content Responsibility

5.1 We reserve the right to review and remove any content submitted by users that violates our terms, including but not limited to content that is illegal, misleading, or harmful.

5.2 Users are responsible for ensuring the accuracy and legality of the information they provide.

6. Data Protection and Privacy

6.1 Your privacy is important to us. We collect and use your information only as necessary to deliver our services, in compliance with our Privacy Policy and applicable data protection laws.

6.2 We commit to protecting your data, employing appropriate security measures to prevent unauthorised access, disclosure, alteration, or destruction of your personal information.

7. Dispute Resolution

7.1 In the event of a dispute arising from the use of our services, we encourage parties to seek an amicable resolution. Should direct resolution fail, we may mediate the dispute, and parties agree to be bound by our decision.

7.2 Further unresolved disputes will be settled through mediation, in accordance with the Centre for Effective Dispute Resolution (CEDR) Model Mediation Procedure, under the laws of England.

7.3 Talent Torch Recruitment Ltd’s liability for any claim arising from the provision of services shall be limited to the total amount paid by the client for the specific service in question.

8. Governing Law

8.1 These Terms are governed by the laws of England. Any disputes related to these Terms will be subject to the exclusive jurisdiction of the English courts.
